My guess is that he had his camera all set to shoot sports action wide open and with center point focusing and just pulled this off quick to try to get the shot before it was too late.

Hey Scott, Question about the photograph you took. I noticed that Demi is in sharp focus while the others are slightly out of focus. I was wondering if you did this on purpose or if this was your wedding photographer instincts kicking in where as long as the woman is in focus nothing else matters or if it’s just a case of get the shot and worry about the rest later.

In any case, I think it’s a good example of where if the woman is in focus then the rest of the picture doesn’t matter as much (unless, I suppose, you’re an Ashton fan).

I had the pleasure of meeting Mike McCaskey at a DLWS event in Moab this year. He is genuinely a supremely nice guy and the most unassuming person you would ever want to meet. He is also a fantastic photographer. He was kind enough to share many of his photos with me as we sat at Moab International waiting on our flight- twin turboprop with pilots who had to be teen-agers(I have pics of Mike asleep!). I think he would make a great guest blogger one Wednesday. He is as articulate as he is nice.

I believe that this would fall under the purview of journalistic photography and therefore requires no model release. If it did, it would kill the paparazzi business. Now if Scott wanted to turn around and sell the image to Nikon for an ad campaign then he would definitely need a release/consent form. By the way Scott, did Ashton have his D90 with him? Probably not.

Scott,

Seriously, do you need a model release to show their photos on your blog? I wouldn’t want you to have any problems. I know you know the legal ramifications being a pro and all, so just thought I would ask.

I thought the rule was that if you can recognize a person’s face in a photo, that you had to have a model release; but that may be if you plan to use it for commercial use in terms of sales.

Just checking.
